Terms of Use

This is an English translation of the Turkish Terms of Use. If the two versions differ, the Turkish version prevails.

1. Parties and Subject Matter

These terms govern the rights and obligations between the person or organisation (the “User”) using the PatentYazarsoftware tool (the “Tool”) and the party providing the service (the “Provider”). Creating an account or using the service constitutes acceptance of these terms.

The Provider that sells the web subscription depends on the User’s billing country:

  • For Users in Türkiye: ZincirX Bilişim Teknoloji ve Danışmanlık A.Ş. — Gülbahçe Mah. Gülbahçe Cad. İYTE Sitesi No: 1/40 İç Kapı No: 51, 35430 Urla/İzmir, Türkiye; Urla Tax Office 9991441373; MERSIS 0999144137300001. Payment is taken in Turkish lira through iyzico on zincirx.com.
  • For all other Users: ZincirX Inc., a Delaware corporation — registered office: c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, United States. Payment is taken in US dollars through Stripe.

2. Nature of the Product (VERY IMPORTANT)

The Tool is not a patent attorney service; it is a software tool. Under Decree-Law No. 551 on the Protection of Patent Rights and the Industrial Property Law (IPL, Law No. 6769), patent attorney services may only be provided by natural or legal persons authorized by TÜRKPATENT.

  • The Tool produces AI-assisted draft texts. Under no circumstances are these texts ready-to-file or final legal documents.
  • Every AI output is marked as a “draft” in the interface.
  • The Tool has NO function for filing, submitting or representing an application before TürkPatent or any other patent office. The Tool only generates and downloads files; the User files the application themselves.

3. User Obligations

  • The User declares that they will use the Tool as a licensed patent attorneyor as an assistant working under a patent attorney’s supervision. Final review, approval and responsibility for the official filing rest with the User.
  • The User undertakes that they have obtained consent to process the inventor/client information they upload (Turkish Personal Data Protection Law, KVKK, Art. 5–6).
  • The User shall not publish patent application data belonging to others in the Tool’s database or use it for commercial advantage.
  • Filing a draft produced by the Tool without checking it may result in a defective application or a refusal; the Provider is not liable for this.

4. Provider Obligations

  • The Tool is operated with reasonable performance for the term of the agreement; the User is notified in advance of interruptions other than scheduled maintenance.
  • User data is processed in accordance with KVKK and retained for the period stated in the Privacy Notice (see Privacy and KVKK Notice).
  • The content of AI outputs is generated with Claude (Anthropic) models. The Provider gives no warranty that these outputs will meet the patentability, novelty or inventive step criteria.

5. Intellectual Property

Content the User creates with the Tool (invention disclosures, generated drafts, diagrams, export files) is owned by the User. The Provider undertakes that this content will not be disclosed to third parties and will not be used for model training.

The Tool, its infrastructure and its brand are owned by the Provider. Reverse engineering, copying and resale are prohibited.

6. Limitation of Liability

The Provider cannot be held liable for:

  • Refusals, oppositions or any other administrative or judicial decisions of TürkPatent, the EPO, the USPTO or any other office.
  • Possible errors, omissions, fabricated citations or unpatentable elements in AI output; the User must check them.
  • Damage arising from incorrect data entered by the User or misuse of the Tool.
  • Outages of third-party services (Anthropic, EPO OPS, Google Patents, Stripe, iyzico).

Any payment or compensation obligation of the Provider is limited to three times the subscription fee for the month in which the event occurred.

7. Subscription, Fees and Refunds

The Tool is offered on a monthly subscription basis. Subscription fees are charged monthly in advance according to the price list in force. Prices are in US dollars (USD), and the price shown is the total the User pays; no VAT is added on top. Users in Türkiye pay ZincirX A.Ş. in Turkish lira through iyzico on zincirx.com: the amount is converted at the Central Bank of the Republic of Türkiye’s (CBRT) USD forex selling rate at the time of payment and rounded to the whole lira, and ZincirX A.Ş. invoices these sales at 0% VAT under the Teknopark exemption. All other Users pay ZincirX Inc. in US dollars through Stripe.

Right of withdrawal: Under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, a User who is a consumer may exercise the right of withdrawal within 14 (fourteen) days of the contract date without giving any reason and receive a full refund. To exercise the right of withdrawal, it is sufficient to send a notice to destek@patentyazar.com within this period.

Refunds: If the User cancels during the subscription term, access to the service continues until the end of the paid period. A pro-rata refund for the remaining days of a started subscription period may only be requested where the service is technically impossible for reasons attributable to the Provider. Once use has begun (after the first project is created), the 14-day right of withdrawal ends upon performance of the service, given its commercial nature (Distance Contracts Regulation, Art. 15/h).

Price changes are announced by e-mail at least 30 days in advance; if the User does not accept the new price, the subscription ends automatically at the end of the current period.

8. Termination

The User may close their account at any time. The Provider may suspend or close the account in the event of a material breach of these terms; prior notice is given where reasonable. Upon termination, the User’s data can be exported within 30 days and is deleted after that period (except the audit log; see the KVKK Notice).

9. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The Istanbul Central Courts and Enforcement Offices have jurisdiction over disputes. The rights of consumer Users under Consumer Protection Law No. 6502 are reserved.

10. Changes

The Provider may update these terms; material changes are announced by e-mail at least 30 days in advance. By continuing to use the Tool after a change, the User is deemed to have accepted the new terms.
